TOS/FAQ

1.) Scope of Work:
a. LITEMITAN (“Artist”) offers services for creating original digital artwork and illustrations based on client requests.
b. The commissioner(“Client”) may request custom artwork, character designs, illustrations, or other related services.2.) Commission Process:
a. The Client will provide a description of the desired artwork, including any specific references, concept ideas, or style preferences.
b. The Artist will review the request and provide a cost estimate and timeline for the project.
c. Once the Client agrees to the terms, including pricing and timeline, both parties will enter into a formal agreement.3.) Payment Terms:
a. The Client agrees to pay the agreed-upon amount for the commissioned artwork as outlined in the invoice provided by the Artist.
b. Payment is required to be 50% up-front unless split into agreed-upon installments, to be documented in an invoice.
c. The Artist retains the right to refuse or cancel a commission if payment is not received as agreed upon. In the event the artwork is completed, the Artist retains the copyrights/ownership rights to the illustration(s).4.) Copyright and Usage:
a. The Artist retains the copyright and ownership of all commissioned artwork.
b. The Client receives a non-exclusive, limited license to use the artwork for personal, non-commercial purposes unless commercial rights are agreed upon and paid for.
c. The Client agrees not to reproduce, distribute, or use the commissioned artwork for commercial purposes without obtaining explicit written permission from the Artist as well as obtaining those rights through payment to the Artist.5.) Revisions and Modifications:
a. The Client may request revisions or modifications to the artwork within the working period.
b. Major changes or additions outside the agreed-upon scope require an additional fee.
c. The Artist will make best efforts to accommodate revision requests, but reserve the right to decline requests that significantly deviate from the original concept.6.) Delivery and File Formats:
a. The final artwork will be delivered to the Client as a high quality PNG, unless otherwise agreed upon.
b. The delivery method and file formats can be changed by agreement between client and the Artist.7.) Confidentiality:
a. The Artist agrees to keep confidential any personal information or proprietary details shared by the Client in relation to the commissioned artwork.
b. The Client agrees not to disclose any confidential information regarding the Artist's personal information and proprietary materials.8.) Cancellation and Refunds:
a. Either party may request cancellation of the commission before its completion, subject to any work already completed and the agreed-upon refund policy. Full refunds will not be possible after 30% of the work has been completed.
b. If the Artist is unable to complete the commission for unforeseen circumstances, the Client will receive a full refund.
c. Refunds for completed work may be subject to negotiation and the specific circumstances of the cancellation.9.) Limitation of Liability:
a. The Artist will make reasonable efforts to deliver high-quality artwork according to the agreed-upon specifications.
b. The Artist will not be liable for any indirect, consequential, or incidental damages arising from the commission, including but not limited to loss of profits or business interruption.By commissioning artwork from the Artist, the Client acknowledges and agrees to these terms of service.
